1. Acceptance of Terms

By accessing or using Zaikatap's website, mobile application, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Services, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of the Services following notification of changes will constitute your acceptance of such changes.

3. Account Registration

To use certain features of the Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with the above requirements.

• Use any robot, spider, or other automatic device to access the Services for any purpose
• Harvest or collect email addresses or other contact information of other users from the Services by electronic or other means
• Use the Services in a manner that could disable, overburden, damage, or impair the Services

5. User Content

The Services may allow you to upload, submit, store, send, or receive content, including but not limited to text, photos, videos, and other materials ("User Content").

You retain all rights in, and are solely responsible for, the User Content you post to the Services. By submitting User Content to the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised.

You represent and warrant that: (i) you own the User Content or have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

6. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Zaikatap, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services, others' content in the Services, Zaikatap trademarks, logos, or other brand features.

7. Payment Terms

Certain aspects of the Services may be provided for a fee. You will be required to select a payment plan and provide accurate information regarding your payment method. You agree to pay Zaikatap the fees in accordance with the payment plan you select.

Zaikatap may change the fees for the Services at any time. If Zaikatap changes the fees for the Services, including by adding additional fees or charges, Zaikatap will provide you advance notice of those changes. If you do not accept the changes, Zaikatap may discontinue providing the Services to you.

You authorize Zaikatap to charge the payment method you provide to us for all applicable fees. If your payment method fails or your account is past due, we may collect fees using other collection mechanisms.

8. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law, is harmful to the interests of another user, a third-party, or the business interests of Zaikatap.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services, or you may contact us at support@zaikatap.com.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

ZAIKATAP DOES NOT WARRANT THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THEY WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZAIKATAP BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
